1. Agreement to these terms
By accessing pagespeed99.com, submitting a contact or audit form, or purchasing services from PageSpeed99, you agree to these Terms of Service ("Terms"). If you do not agree, do not use our website or services.
"PageSpeed99," "we," "us," and "our" refer to Nobash LLC, operating the PageSpeed99 brand. "You" and "Client" refer to the individual or organization using our services.
2. Services
PageSpeed99 provides WordPress and WooCommerce performance optimization services, including but not limited to:
- WordPress speed optimization
- Core Web Vitals (LCP, INP, CLS) improvement
- WooCommerce and checkout performance tuning
- Free written speed audits and fixed-price quotes
Services are delivered remotely. We do not provide general web design, SEO content writing, or unrelated development unless explicitly included in your written quote.
3. Free audits & quotes
Free speed audits are provided at our discretion for qualified WordPress or WooCommerce sites. An audit includes our analysis and a fixed-price quote — it does not obligate you to purchase, and it does not obligate us to accept every project.
Audit reports reflect conditions at the time of review. Scores and recommendations may change if your site, hosting, or third-party services change after the audit date.
Quotes are valid for the period stated in the quote document (typically 30 days unless otherwise noted). Work begins only after written acceptance and payment as specified in your quote.
4. Payment terms
All prices are fixed and stated in USD unless otherwise noted. We do not bill hourly unless explicitly agreed in writing for a custom engagement.
Payment is due as specified in your quote — typically 100% upfront for standard projects, or 50% upfront / 50% before live deployment for larger scopes. We accept payment methods stated in your invoice.
Work does not begin until payment is received and required access credentials are provided. Late payment may delay project start and delivery timelines.
5. Performance guarantee
Certain paid projects include a written PSI 90+ and/or Core Web Vitals guarantee as defined in your project quote ("Guarantee"). The Guarantee applies only to paid optimization projects — not to free audits.
Guarantee conditions include, but are not limited to:
- Targets and measurement method defined in your quote (e.g., mobile PSI, specific URLs, CWV pass status)
- Your site remains on the agreed hosting and stack during the guarantee period
- No material changes to theme, page builder, plugins, or content without our review
- You do not install performance-degrading plugins or scripts after delivery
If guaranteed metrics are not met within the agreed verification window, we will continue optimization work at no additional charge until targets are met, or provide a refund as specified in your quote — whichever applies per your written agreement.
PageSpeed99 is not affiliated with Google. PSI and Core Web Vitals are third-party metrics; we do not control how third-party tools calculate or display scores.
6. Your responsibilities
You agree to:
- Provide accurate site URLs and project information
- Supply timely access to staging, hosting, DNS, or CDN accounts when requested
- Maintain current backups before any live deployment
- Review and approve staging changes before we push to production
- Notify us promptly of any issues discovered after delivery
- Ensure you have rights to authorize us to work on the website
Delays caused by missing access, incomplete information, or unapproved third-party changes may extend timelines and are not our responsibility.
7. Access, staging & backups
We strongly prefer staging-first delivery. Where staging is unavailable, you acknowledge that optimization on a live site carries inherent risk despite our best practices.
You are responsible for maintaining full site and database backups before we begin work. While we take care to avoid disruption, we are not liable for data loss where adequate backups were not maintained.
Credentials you provide are used solely for the project and handled securely. We recommend creating limited-access accounts where your host allows it.
8. Project scope & changes
Each project is defined by the written quote or statement of work you accept. Work outside that scope — including new pages, plugin installs, design changes, or additional URLs — requires a change order and may incur additional fees.
If we discover constraints that prevent reaching quoted targets (e.g., unacceptable hosting, prohibited plugin conflicts, or site owner restrictions), we will notify you promptly and propose alternatives before proceeding.
9. Revisions & post-delivery support
Standard projects include a post-delivery support window as stated in your quote (typically 30 days) for issues directly related to our optimization work. Support does not cover unrelated bugs, content updates, new features, or problems caused by changes you or third parties make after delivery.
After the support window, additional work is available at our then-current fixed rates or a new quote.
10. Refunds & cancellations
Because our work is custom and begins quickly, payments are generally non-refundable once work has started — except where our written Guarantee provides for a refund if targets are not met.
If you cancel before work begins, we may refund your payment minus any non-recoverable costs, at our discretion. If you cancel after work has started, no refund is owed for completed or in-progress work.
Chargebacks filed without contacting us first to resolve an issue may result in termination of services and recovery of associated costs.
11. Intellectual property
Upon full payment, you receive the benefit of optimizations applied to your site. Custom code or configuration we create for your project becomes part of your site. We retain the right to use general techniques, non-proprietary methods, and anonymized before/after metrics for marketing unless you request otherwise in writing.
Our website content, branding, audit report templates, and proprietary processes remain our intellectual property.
12. Confidentiality
We treat your site data, credentials, analytics, and business information as confidential. We do not sell client information. We may use anonymized, non-identifiable performance results (e.g., "PSI improved from 34 to 94") in marketing unless you opt out in writing.
13. Third-party tools & affiliate links
Our work may involve third-party hosting, plugins, CDNs, and monitoring tools. We are not responsible for third-party pricing, uptime, policy changes, or service discontinuation.
Our Recommended Tools page may include affiliate links. See that page and our footer disclaimer for details. Affiliate relationships do not increase the price you pay for those tools.
14. Limitation of liability
To the maximum extent permitted by law, PageSpeed99 and Nobash LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data — even if we have been advised of the possibility.
Our total liability for any claim arising from a project shall not exceed the amount you paid us for that specific project in the twelve (12) months preceding the claim.
Performance improvements depend on many factors outside our control. We make no warranty that speed gains will translate to specific business outcomes such as rankings, conversions, or revenue.
15. Termination
We may refuse or terminate service if you breach these Terms, provide fraudulent information, abuse our team, or fail to pay amounts due. You may stop using our website at any time. Provisions that by nature should survive termination (payment obligations, liability limits, intellectual property) will survive.
16. Governing law & changes
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law principles. Any dispute shall be resolved in courts located in Wyoming, unless otherwise required by applicable law.
We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
